ADVANCE HEALTHCARE DIRECTIVES AND POWERS OF ATTORNEY FOR PERSONAL CARE IN ONTARIO

WHAT IS A POWER OF ATTORNEY FOR PERSONAL CARE?

A Power of Attorney for Personal Care (POAPC) is a legal document that allows you (the grantor) to appoint someone (your attorney) to make decisions about your healthcare, medical treatments, housing, and other personal care matters if you become incapable of making these decisions yourself.

Your attorney for personal care can make decisions about:

· Medical treatments, including life support and pain management

· Living arrangements (e.g., home care vs. long-term care)

· Nutrition and hydration

· Personal safety and hygiene

This document only takes effect when you are deemed mentally incapable of making personal care decisions.

WHAT IS AN ADVANCE HEALTHCARE DIRECTIVE?

An Advance Healthcare Directive (often called a “living will”) is a written statement outlining your healthcare preferences, including life-sustaining treatment and end-of-life care.

While Ontario law does not officially recognize a standalone “living will,” an Advance Directive can be included within a Power of Attorney for Personal Care to guide your attorney in making medical decisions.

Your directive may include instructions on:

· Resuscitation – Whether you wish to be resuscitated if your heart stops.

· Life Support – Your wishes regarding ventilators, feeding tubes, and artificial hydration.

· Pain Management & Palliative Care – Preferences on pain relief and comfort measures.

· Organ Donation – Consent or refusal to donate organs and tissues.

Your healthcare provider and attorney must follow your expressed wishes as long as they are clear and applicable to the situation.

WHY YOU NEED BOTH A POWER OF ATTORNEY FOR PERSONAL CARE AND AN ADVANCE DIRECTIVE

While a POAPC grants legal authority to your chosen decision-maker, an Advance Directive provides guidance on how you want them to act. Without a clear directive, your attorney may have to make difficult choices without knowing your exact wishes.

CHOOSING THE RIGHT ATTORNEY FOR PERSONAL CARE

The person you appoint as your attorney for personal care should be:

✔ Willing to advocate for your wishes and best interests

✔ Capable of making difficult medical decisions

✔ Familiar with your values and healthcare preferences

WHO CAN YOU APPOINT?

· A spouse, partner, or adult child

· A close friend or family member

· Any person over 16 years old

· You can also appoint more than one attorney, either jointly (must agree on decisions) or separately (each can act independently).
